TownMesh is a social platform that connects people with those around them. Our website address is www.townmesh.com

This agreement (“Agreement”) describes your rights and responsibilities in your use of TownMesh’s Sites, and service, both as a visitor and as a registered TownMesh member, and what you can expect from us. By continuing to use our Sites, you are agreeing to this legally binding agreement.

TownMesh is a social network; “Sites” as used here, refers to the TownMesh Website, iOS, and Android apps (also referred to as our “Services”) that provide you with access to that platform.

Each person can only have one account, and you may not share your account login information with anyone else (even a family member) or allow someone else to use your personal account. You must use your real name, not a pseudonym. If you are under 13 years old (or any older age of consent required to use social media services where you live), do not use our services or provide any data to us, based on jurisdiction, if you are under the legal age, by creating an account, you confirm that a parent or legal guardian has given consent to this agreement and your use of TownMesh. Convicted sex offenders are not eligible for TownMesh accounts. We may deny account registrations we think would harm a TownMesh member.

It is not OK to submit inaccurate registration information or to register if you know you don’t meet our eligibility requirements. Providing false registration information violates our norms and could constitute a crime. We make efforts to enforce our eligibility requirements, but please do not assume these processes are perfect.

We will never sell or rent your personal information to third parties, and we won’t share it with a third party unless we have your authorization. Our privacy policy explains how we handle member and visitor data collected and generated in the course of visiting or using TownMesh. Please read it, as it forms part of this agreement.

By continuing to use TownMesh, you authorize us to transfer and store your data as described in our privacy policy. TownMesh will only transfer personal data as permitted by law and will take steps intended to ensure appropriate protection of your personal information; please review our privacy policy for details. You give TownMesh permission, in the form of a nonexclusive worldwide license, to use, copy, and publish your Content based on your TownMesh settings and the selections you make when posting and as otherwise described in our privacy policy.

We require that you adhere to our guidelines as they are become updated and the practice of good citizenship. Do not publish any Content that you don’t have the right to publish, or that is defamatory, infringing, illegal, or otherwise tortious. We do not proactively screen or monitor Content posted by members; however, we can remove Content posted by you, suspend, delete or deactivate your account or other privileges, or otherwise refuse service to you, if you violate this agreement or our other policies, or infringe the intellectual property, or otherwise engage in behavior that we think harms a TownMesh member.

Feedback: We encourage feedback about TownMesh, so long as you understand that we may have already had the same idea, and you agree that we are free to use any feedback you voluntarily provide with no restriction or obligation (payment or otherwise) to you.

App Usage Charges: TownMesh does not charge for use of our app or for sending text messages, but your carrier may charge you. Some of the information and services available through TownMesh are licensed from third parties and covered by these third-party terms and disclosures:

Loss: We are not liable in any manner for any losses incurred as a result of your use of our Sites, services, or software to you for any amount. By continuing to use our Sites, you agree that you are fully responsible for any material you post, or people that you engage with, or any outcome as a result of using our Sites or services and that you do so at your own free will. TownMesh is NOT a legal platform. TownMesh offers its Sites and services AS IS. We do not promise that any aspect of our software or service will work properly or continuously. We may add, change, or discontinue product features; if you are dissatisfied, your only remedy is to stop using TownMesh or the affected feature

Amendments to the Agreement: We can amend this agreement, any additional terms, or the privacy policy by notifying you of the changes (for example, by emailing you, or by posting an amendment notice in your news feed). If you keep using TownMesh after the amendment is effective, you accept and are bound by the new terms; if you disagree with the new terms, you should stop using TownMesh and delete your account.

Disputes and Claims: If you have a dispute with TownMesh, you agree to contact us and try to resolve the dispute informally before pursuing other avenues. If someone brings a claim against TownMesh (or any of its associates) based on a harm you caused, you agree to reimburse us for any costs we incur in defending against that claim, including reasonable attorneys’ fees as well as damages. If you have a dispute with another TownMesh member, we hope that you will be able to work it out amicably. However, if you cannot, please understand that TownMesh is not responsible for the actions of its members; each member is responsible for their own actions and behavior, whether using TownMesh. By continuing to use TownMesh, you agree to release TownMesh from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes

This agreement does not create any agency, partnership, joint venture, employment, or franchise relationship. This Agreement is binding. Any unenforceable portion of this agreement shall be enforced to the maximum extent possible, and the remaining portions shall be given full effect. Our failure to act in a particular circumstance does not waive our right to act with respect to that or other circumstances. We shall be excused for any problem due to a circumstance beyond our reasonable control.
